3. May 2022 – Judgment of the ECJ on the enforcement of patents by preliminary injunction
With the ECJ ruling of April 28, 2022, it was decided that a preliminary injunction in patent infringement cases can be issued even if the patent in dispute has not yet proven to be legally valid in two-sided opposition or nullity proceedings.
According to previous case law, in order for a preliminary injunction to be issued, the asserted patent also had to have been defended in bilateral proceedings for legal validity, because only then was the existence of the right sufficiently secured.
The Munich Regional Court had questioned this common practice of German courts and had it examined whether the strict requirements are in line with European law. The ECJ now clarified that such a high hurdle may not be required for the legal validity.
18. April 2022 – EPO: European patent applications to reach record level in 2021
In 2021, 4.5% more patent applications were filed at the European Patent Office (EPO) in Munich than in 2020. Patent activity has been particularly high in digital technologies and in the area of healthcare technologies.
The strongest growth has occured in digital communications (+ 9.4% compared to 2020) and computer technology (+ 9.7%).
In a country comparison, the USA is again in first place with 25% of all European patent applications, followed by Germany (14%), Japan (11%) and China (9%). Patent applications by Chinese companies continued to grow particularly strongly with +24 % compared to 2020 and have more than quadrupled over the last 10 years.
