25. March 2024 – EPA Patent Index 2023

Dem vom Europäischen Patentamt jüngst veröffentlichten Patent Index zufolge stieg die Anzahl europäischer Patentanmeldungen - im Vergleich zum Jahr 2022 - um 2,9 % ...

Die meisten EPA-Anmeldungen erfolgten in den Bereichen digitale Kommunikation (einschließlich Mobilfunktechnologien), Medizintechnik und Computertechnologie.

Die USA machten auch im Jahr 2023 wieder knapp ¼ des gesamten Anmeldeaufkommens aus, gefolgt von Deutschland, Japan, China und Korea.

Seit dem 1. Juni 2023 können Einheitspatente beim EPA angemeldet bzw. registriert werden; seitdem ist für 17,5 % aller europäischen Patente, die erteilt wurden, die einheitliche Schutzwirkung beim EPA beantragt worden.

9. January 2024 – CES, Las Vegas

At CES 2024, companies from the technology sector present their latest innovations and products. This year, the focus is particularly on innovations in the technology areas of artificial intelligence and autonomous driving.

The CES in Las Vegas is one of the most important and largest trade fairs in the tech industry. Participants come primarily from the audio-video, household electronics, food and healthcare technology, gaming hardware, laptops and automotive industries. The topic of artificial intelligence is the central element of the company presentations this year.

7. December 2023 – Changes in trademark law in China

The Chinese National Intellectual Property Administration (CNIPA) is planning a revision of the Trademark Law of the People's Republic of China, which is to be passed next year.

The draft amendment published at the beginning of 2023 provides for various updates to strengthen the position of trademark owners in protecting their rights.

These include, among others:

  • Prohibition of repeated registrations: The re-application of identical trademarks by the same applicant should no longer be permitted in principle.
  • Malicious trademark applications: Stronger sanctions are planned for trademark applications made in bad faith (e.g. by means of deception).
  • Declaration of trademark use: Trademark owners are to be obliged to make regular declarations to the CNIPA on the status of trademark use.
  • Reduction of the opposition period: This is to be reduced from three to two months

The Trademark Act was last revised in 2019.

23. November 2023 – DPMA: Herstellernachweis auf Patentdokumenten

Auf allen vom DPMA veröffentlichten Patentdokumenten (Offenlegungsschrift, Patentschrift, Gebrauchsmusterschrift) wird auf die produzierende Druckfirma hingewiesen. Das Impressum lautet aktuell: „Das Dokument wurde durch die Firma Luminess hergestellt“.

Dieser Hinweis wird nach Auskunft des DPMA seit April 2020 auf allen deutschen Patentdokumenten auf der letzten Seite abgedruckt, nachdem im Rahmen einer öffentlichen Ausschreibung im Jahr 2018 die Firma Jouve (jetzt Luminess) die Produktion übernommen hatte.

Auf Patentdokumenten des Europäischen Patentamts (EPA) ist die Referenz auf den Dienstleister, der das Dokument hergestellt hat, auf der ersten Seite gedruckt.

7. November 2023 – 3D printing technologies

Over the last 10 years, there has been a sharp increase in international patent applications in the field of 3D printing. According to the EPO study, almost three quarters of global 3D printing innovations come from the USA and Europe.

The study published by the EPO in September 2023 shows that an increasing number of patents have been filed in the field of 3D printing technologies since 2013; international patent families in this field have grown at an average annual rate of 26.3%.

Patent applicants in the field of additive manufacturing are large mechanical engineering companies from the USA, Europe and Japan as well as specialized 3D printing companies and start-ups. In total, more than 50,000 international patent families for 3D printing technologies have been filed worldwide since 2001.

28. September 2023 – New WIPO study

The Global Innovation Index 2023 was published in Geneva on September 27. Every year, the World Intellectual Property Organization (WIPO) examines and evaluates the global innovation performance of 132 economies based on around 80 indicators ...

For example, the registration rates in the field of IP or the number of companies and institutions that are active in R&D are examined. Germany is once again in 8th place in this year's country comparison.

WIPO divides the world's most innovative regions into so-called science and technology clusters. These are determined by analyzing patent applications and publications of scientific articles, whereby the geographical areas with the highest density of inventors and scientific authors around the world are documented. Nine German cities are among this year's top 100 clusters.

4. September 2023 – EPA Dashboard: Requests for unitary effect

The European Patent Office (EPO) has set up a dashboard that provides daily updates on the status of unitary patent registrations and shows, among other things, in which of the eight major technology sectors the patents are to be classified.

According to the EPO, an average of 670 applications have been filed each week since the introduction of the unitary patent system. More and more patent owners want to benefit from the greater country coverage (currently 17 participating states) and the lower overhead and administrative costs, the EPO newsletter report says.

16. August 2023 – EPG Update

Dieser Tage wurden 21 neue technisch qualifizierte Richter für das EPG ernannt. Insgesamt werden 105 juristisch und technisch qualifizierte Richter am Einheitlichen Patentgericht urteilen, viele davon aus Deutschland.

JUVE Patent hat einen Überblick über alle Richter, ihre Herkunft, ihre bisherigen Positionen und ihre Aufgaben am UPC erstellt und am 16. August 2023 auf juve-patent veröffentlicht.

10. August 2023 – Thema: Vertretungsbefugnis für Patentanwälte

Der Bundesverband Deutscher Patentanwälte hat Anfang August eine Stellungnahme veröffentlicht betreffend der Vertretungsbefugnis für Patentanwälte in Verfahren vor den Land- und Oberlandesgerichten.

Der Verband vertritt die Meinung, dass Patentanwälte in gerichtlichen Verfahren bei Patent-, Gebrauchsmuster-, Marken- oder Designstreitigkeiten nicht länger nur auf das Mitwirken beschränkt sein sollten, sondern ebenso wie Rechtsanwälte das volle Vertretungsrecht erlangen sollten. 5. June 2023 – Unitary patent and UPC

Since June 1, 2023, when the UPC Agreement enters into force, unitary patents can be applied for or registered at the European Patent Office (EPO). Further information about the European patent with unitary effect (UPC).

29. March 2023 – EPA Patent Index 2022

Dem jüngst vom EPA veröffentlichten Patent Index zufolge stiegen die Patentanmeldungen beim Europäischen Patentamt im Jahr 2022 um 2,5% gegenüber dem Vorjahr ...

Dieser Anstieg lässt sich vor allem mit der anhaltenden Zunahme der Einreichung von Anmeldungen aus China erklären.

Deutsche Unternehmen reichten 2022 mehr Anmeldungen in den Bereichen Computertechnik (+3,3%), Biotechnologie (+1,6%) und Spezialmaschinen (+1,9%) ein. Die anmeldestärksten Technologiefelder waren die Sektoren elektrische Maschinen/Geräte/Energie, Transport und Messtechnik. Im weltweiten Vergleich liegt Deutschland weiterhin auf Platz 2, auch wenn ggü. dem Vorjahr insgesamt weniger Patente (-4,7%) angemeldet wurden.

Den größten absoluten Zuwachs verzeichneten die Anmeldungen aus China und den USA. Die USA machten auch im Jahr 2022 wieder knapp ¼ des gesamten Anmeldeaufkommens aus (u.a. mehr Anmeldungen in den Bereichen digitale Kommunikation und elektrische Maschinen/Geräte/Energie). Aus China wurden 15,1% mehr Anmeldungen gegenüber dem Vorjahr beim EPA eingereicht.

Allgemein sind die Anmeldezahlen bei digitalen Technologien und Energietechnologien stark gestiegen. Das größte Wachstum unter den führenden Technologiefeldern verzeichnet laut Index der Bereich elektrische Maschinen/Geräte/Energie (+18,2% - Stichwort: Anmeldeboom in der Batterietechnik).

18. February 2023 – Ratifikationsurkunde zum Einheitlichen Patentgerichts-Übereinkommen (EPGÜ)

Deutschland hat gestern das Übereinkommen über ein Einheitliches Patentgericht (UPC) ratifiziert.

7. February 2023 – WIPO / internationale Markenanmeldung

Ab dem 1. Februar 2023 können internationale Anmeldungen für Klangmarken, Filmmarken und andere Arten von Multimedia-Marken in einem digitalen Format eingereicht werden.

Es sind keine grafischen Darstellungen der anzumeldenden Marke mehr erforderlich. Voraussetzung ist, dass die Darstellung der Basismarke das gleiche Format aufweist.

5. December 2022 – UPC: Start of Sunrise Period postponed by two months

It has today been announced today that the start of the Sunrise Period will be postponed to March 1 2023 in order to give future users more time to prepare for the authentication required for the Case Management System (CMS) and to sign documents. The new start date for the UPC has been set for June 1, 2023.Further information.

18. November 2022 – EPA and UPC sign data exchange agreement

The European Patent Office (EPO) and the Unified Patent Court (UPC) have signed an agreement on data exchange between the two institutions.

The agreement creates the legal basis for facilitating the exchange of data between the EPO patent register and the UPC register. Among other things, the aim is to support the UPC in establishing an IT-driven unified patent jurisdiction and to cooperate in the training of UPC judges. The agreement will take effect upon the entry into force of the Unified Patent Court Agreement.

10. October 2022 – Unified Patent Court expected to start in April 2023

The UPC Convention is currently scheduled to enter into force on April 1, 2023. The implementation plan of the Unified Patent Court has now been published and summarizes the upcoming activities for the coming months. According to this plan, the sunrise period will start on January 1, 2023.

30. September 2022 – Global Innovation Index 2022

Der neue UN-Innovationsindex wurde gestern veröffentlicht. Jährlich untersucht und bewertet die WIPO die Innovationsleistung von 132 Volkswirtschaften auf Basis von rund 80 Indikatoren, u.a. auch die Anmeldequoten im Bereich IP und die Anzahl an Unternehmen und Institutionen, die in Forschung & Entwicklung tätig sind.

15 der Top-25-Innovations-Länder sind in Europa angesiedelt. Die Schweiz steht erneut auf Position 1 - gefolgt von den USA, Schweden, Großbritannien, die Niederlande, Südkorea und Singapur. Deutschland steht bei dem diesjährigen Ländervergleich auf dem achten Platz.

Laut Bericht sind der derzeitige technologische Fortschritt und die Übernahme von Technologien Anzeichen für eine Verlangsamung des Wachstums, obwohl die F&E-Ausgaben und die Risikokapitalinvestitionen, welche die weltweite Innovationstätigkeit vorantreiben, im Jahr 2021 trotz der COVID-19-Pandemie stark angestiegen sind.

13. September 2022 – Irreführende Anfragen von chinesischen Anbietern zu Domain-Registrierungen

Unternehmen erhalten derzeit vermehrt Emails von dem Absender „Domain Registry China (Head Office)“. Vorsicht ist geboten: Chinesische Anbieter versuchen, Unternehmen überteuerte Domainnamen zu verkaufen.

Inhaltlich geht es darum, dass mitgeteilt wird, dass eine erweiterte Markenprüfung auf internationaler Ebene durchgeführt wurde und man bestätigen solle, ob das genannte chinesische Unternehmen entweder Vertriebshändler oder Geschäftspartner in China ist.

Es handelt sich um den Versuch, den Unternehmensnamen unter den Top-Level-Domains .cn, .com.cn, .net.cn und .org.cn zu registrieren. Das Bestehen von Interessen Dritter an der Domainregistrierung ist fiktiv und dient dazu, relevante Domains zu einem hohen Preis zu verkaufen.

28. July 2022 – Update: Unitary Patent Court

As things stand, the Unified Patent Court (UPC) and the European Unitary Patent (EP) will start work in spring 2023. It is expected that preparations can be completed by the end of 2022.

The locations of the regional and local chambers of the UPC have been determined: The German regional chamber of the UPC will be in Munich and 4 German local chambers will be established at the regional courts of Munich, Mannheim, Düsseldorf and Hamburg. The appointment and publication of the UPC judges is expected soon.

On July 8, the Administrative Committee had finalized the Rules of Procedure of the UPC and the Schedule of Fees. Both will come into force on September 1, 2022.

7. June 2022 – DPMA Annual Report 2021

The number of patent applications at the DPMA in 2021 remains high at 58,568 - despite a slight decrease compared to the previous year (-5.7%). The largest increase in applications in 2021 was recorded in the technology field of computer technology (+6.3%).

The report says, among other things: In this field, applications are mainly filed for systems for image data processing, speech recognition or information and communication technology. Developments that use artificial intelligence or machine learning play a major role here.

In terms of trademark applications, 87,631 applications were received during the period under review (+3.6% compared to the previous year 2020). A decline in the number of applications was recorded for design applications (-16.3%) and utility model applications (-14.1%).

3. May 2022 – Judgment of the ECJ on the enforcement of patents by preliminary injunction

With the ECJ ruling of April 28, 2022, it was decided that a preliminary injunction in patent infringement cases can be issued even if the patent in dispute has not yet proven to be legally valid in two-sided opposition or nullity proceedings.

According to previous case law, in order for a preliminary injunction to be issued, the asserted patent also had to have been defended in bilateral proceedings for legal validity, because only then was the existence of the right sufficiently secured.

The Munich Regional Court had questioned this common practice of German courts and had it examined whether the strict requirements are in line with European law. The ECJ now clarified that such a high hurdle may not be required for the legal validity.

18. April 2022 – EPO: European patent applications to reach record level in 2021

In 2021, 4.5% more patent applications were filed at the European Patent Office (EPO) in Munich than in 2020. Patent activity has been particularly high in digital technologies and in the area of healthcare technologies.

The strongest growth has occured in digital communications (+ 9.4% compared to 2020) and computer technology (+ 9.7%).

In a country comparison, the USA is again in first place with 25% of all European patent applications, followed by Germany (14%), Japan (11%) and China (9%). Patent applications by Chinese companies continued to grow particularly strongly with +24 % compared to 2020 and have more than quadrupled over the last 10 years.

30. March 2022 – EUIPO: Number of EU trademark applications on the rise

The European Union Intellectual Property Office (EUIPO) has recorded an increase in EU trademark applications of +10% in 2020 and +12% in 2021 - both compared to the previous year.

In the last 10 years, there has been an increase in trademark applications from China in particular. In 2020 and 2021, China was the country with the most applications at the EUIPO, followed by Germany and the USA. For the year 2022, a significant increase of EU trademarks in EU member states can be seen. More information:EUIPO Statistics.

9. March 2022 – Europol report on product piracy in EU

Trade in counterfeit and pirated goods has continued to increase during the Covid 19 pandemic, especially in pharmaceuticals, food, cosmetics, and toys.

The report by Europol and the European Union Intellectual Property Office (EUIPO) is based on data collected in the EU and Europol operational information. Imports of counterfeit and pirated goods amounted to €119 billion in 2019, which is almost 6% of all goods imported into the EU.

Online platforms, social media, and instant messaging services are increasingly being used to distribute counterfeits.

23. February 2022 – Record number of applications for EU trademarks

The European Union Intellectual Property Office (EUIPO) is reporting a record number of EU trademark applications; nearly 11% more than in 2020 - and expects a further upward trend in the registration of EUTM and design applications, which are valid throughout the EU.

Applications for EU trademarks (nearly 200k in 2021) and registered Community designs (nearly 116k in 2021) were filed almost exclusively through EUIPO's e-filing portals last year. More information on the total number of applications and registrations at EUIPO statistics.

5. February 2022 – China joins the Hague Model Convention

China has acceded to the Hague Design Agreement, which will enter into force on May 5, 2022. International designs can now also be registered with WIPO with protective effect for China. However, design protection does not extend to the territory of Hong Kong and Macao.

Through a standardized procedure, the international Hague Design Agreement offers the possibility to register a design in several countries beyond the EU with one central application to WIPO.More on this in our blog International design protection: The Hague Agreement.

27. January 2022 – Vorbereitungen für Einheitliches Patentgericht (UPC) können beginnen

Das seit Jahren geplante Einheitliche Patentgericht der EU-Staaten kann im Jahr 2022 weiter vorangetrieben werden. Österreich hatte Mitte Januar 2022 als 13ter EU-Mitgliedstaat das PAP-Protokoll ratifiziert, so dass dieses nun in Kraft treten kann.

Die Satzung gibt nämlich vor, dass für das Inkrafttreten 13 EU-Mitgliedstaaten dem Protokoll über die vorläufige Anwendung des Übereinkommens über ein einheitliches Patentgericht (PAP) beitreten müssen.

Mit Inkrafttreten des PAP-Protokolls können nun die Leitungsorgane des Gerichts zusammengesetzt und auch die Richter für das Einheitliche Patentgericht ausgewählt werden. Deutschland hatte das PAP-Protokoll im September 2021 ratifiziert. Durch die vorangegangenen Verfassungsbeschwerden, über die das Bundesverfassungsgericht entscheiden musste und durch den Austritt des Vereinigten Königreichs aus der EU hat sich die Einführung des Einheitspatents immer weiter verzögert. Das Vereinigte Königreich hatte im Juli 2020 im Rahmen des Brexit seine Ratifikation zurückgezogen.

27. September 2021 – Patente | Global Innovation Index 2021

Die Weltorganisation für geistiges Eigentum (WIPO) hat im September den globalen Innovationsindex 2021 veröffentlicht. Die Mehrheit der 25 innovativsten Volkswirtschaften kommen aus Europa.

Betrachtet wurden die wirtschaftliche und soziale Entwicklung von 132 Volkswirtschaften auf Basis von 81 Indikatoren, u.a. auch die Anmeldequoten im Bereich IP und die Anzahl an Unternehmen und Institutionen, die in der Forschung und Entwicklung tätig sind.

Deutschland steht im Länderranking – über alle Bewertungskategorien betrachtet – auf Platz 10. Die USA sind (Platz 3) nach wie vor sehr innovationsstark. Bei den asiatischen Volkswirtschaften sind 5 Länder unter den Top 15 Plätzen gerankt: Korea (5), Singapur (8), China (12), Japan (13) und Hongkong (14).

8. July 2021 – Eintragung einer Soundmarke für das Öffnen von Getränkedosen vorläufig abgelehnt

Vor dem Gericht der Europäischen Union (EuG) ist gestern in einem Markenverfahren des Dosenherstellers Ardagh Metal Beverage Holdings Germany GmbH aus Bonn gegen das Amt der Europäischen Union für geistiges Eigentum (EUIPO) eine Entscheidung gefallen (Az.T-688/19): Der Antrag auf Markeneintragung eines speziell entwickelten Sounds für das Öffnungsgeräusch einer Getränkedose wurde vom EuG abgelehnt. Ardagh, vertreten durch die Patentanwälte karo IP und die Prozessanwälte Löffel Abrar, prüft derzeit Rechtsmittel beim Gerichtshof der Europäischen Union gegen die Entscheidung des Gerichts.

16. June 2021 – Der Patent-Krieg ums Bier: Was das für des Deutschen liebstes Getränk bedeutet

Manche schäumen vor Wut wie ein frisch gezapftes Bier: Das Europäische Patentamt mit Sitz in München hat entschieden, dass die Bierbrauer Carlsberg und Heineken zu Recht ein Patent (EP 2 373 154 B1) auf Braugerste erhalten haben. Gegner befürchten, dass nun rund ums Bier noch viel mehr Patente vergeben werden. Was bedeutet das für des Deutschen liebstes Getränk? 15. April 2021 – Brexit: UK Patentanwälte verlieren Vertretungsbefugnis in Deutschland

Als Mitglied in der EU konnten britische Patentanwälte (Patent Attorneys) in Deutschland als Patentanwälte tätig sein. Mit dem Brexit und nach Ablauf der Übergangsphase, die am 31.12.2020 endete, ...

haben UK Patentanwälte keine Vertretungsbefugnis mehr vor dem Deutschen Patent- und Markenamt. Das Gesetz über die Tätigkeit europäischer Patentanwälte in Deutschland (EuPAG) wurde entsprechend angepasst.

Britische Patentanwälte, die eine Zulassung als European Patent Attorney haben, können aber weiterhin Mandanten in Deutschland vertreten.

10. April 2021 – WIPO Report zu Innovationen im Bereich assistiver Technologien

Mehr als 130.000 Patente für unterstützende Technologien sind in den letzten 22 Jahren veröffentlicht worden, berichtet die WIPO in ihrem Report „Technology Trends 2021 – assistive Technologies“.

Damit gemeint sind Innovationen von technischen Hilfsmitteln jeglicher Art, die Menschen mit Hilfebedarf oder Behinderung im Alltag unterstützen können.

Laut WIPO werden assistive Systeme und Technologien zunehmend in der Konsumgüterindustrie angewendet bzw. integriert. Das Entwicklungspotential ist groß. Über Informations- und Kommunikationsmedien können diese Technologien mit Produkten des Alltags verbunden werden. So ermöglichen Fernsteuerungen (z.B. Rolläden) oder automatische An- und Abschaltungssysteme (z.B. Küchengeräte) die Automatisierung alltäglicher Arbeiten.

Sehr viel tut sich laut WIPO im Bereich von aufstrebenden Technologien, z.B. im Zusammenhang mit Hilfsrobotern, Smart-Home-Anwendungen und Smartglasses. Technologien, die für Personen mit Beeinträchtigungen entwickelt wurden, werden zunehmend auch im Konsumgüterbereich angewendet.

Derartige Innovationen kommen vornehmlich aus China, USA, Deutschland, Japan und Korea. Zur Mitteilung der World Intellectual Property Organization (WIPO).

10. March 2021 – Patente in der Medizintechnik – Lebensretter und Innovationstreiber

Patientenüberwachungs- und Beatmungsgeräte – vor der Corona-Pandemie waren solche Geräte allenfalls Intensivmedizinern und ein paar Insidern ein Begriff. Doch das hat sich grundlegend geändert. In den vergangenen Monaten ist die Nachfrage nach den Hightech-Maschinen sprunghaft angestiegen. Technische Neuerungen und verbesserte Geräte gewinnen dabei zunehmend an Bedeutung, denn die Qualität der Geräte ist entscheidend für das Überleben der Patienten. Das Beispiel macht klar: die Medizintechnik wächst dynamisch, die High-Tech-Branche wird auch langfristig immer wichtiger. Der Patentschutz von neuartigen Erfindungen ist dabei ein enorm wichtiger Innovationsförderungsmechanismus.

24. February 2021 – EPA Studie: Internationale Patentanmeldungen im Bereich der 4IR-Technologie

Ende letzten Jahres hatte das Europäische Patentamt die Studie „Patents and the Fourth Industrial Revolution“ veröffentlicht, in der internationale Patentfamilien von 4IR-Technologien untersucht wurden. Im Betrachtungszeitraum der Jahre 2010 bis 2018 sind der Studie zufolge weltweit überdurchschnittlich viele Patente im Bereich der digitalen Technologien (5G, Big Data, Internet der Dinge, Künstliche Intelligenz) angemeldet worden.

Die Zahl der weltweiten Patentanmeldungen ist in diesem Zeitraum mit einer durchschnittlichen jährlichen Rate von rund 20 % gewachsen. Demnach wachsen die Technologien der 4. Industriellen Revolution fünfmal schneller als der Durchschnitt aller Technologiefelder. Erfindungen in den Industrie-4.0-Kerntechnologien IT-Hardware, Software, Konnektivität und Datenmanagement verzeichnen das stärkste Wachstum.

Im Ländervergleich sind die USA mit rund einem Drittel aller Erfindungen führend bei der Anmeldung von Patenten für vernetzte intelligente Technologien. Es folgen Japan, China und Südkorea, wo insb. im Bereich 5G und Big Data große Wachstumszahlen vorliegen.

Die Studie des EPA basiert auf dem Konzept der internationalen Patentfamilien (IPF). Eine Patentfamilie steht für eine Erfindung, die bei mindestens 2 Patentämtern eingereicht und veröffentlicht wurde. Untersucht wurden alle IPF, die weltweit zwischen 2000 - 2018 von Unternehmen und Erfindern in über 350 verschiedenen Technologiefeldern eingereicht worden sind. 9. February 2021 – E-Fuels: Deutsche Automobil- und Energieindustrie schreiten gemeinsam voran

Nichts treibt die Automobilindustrie zurzeit mehr um als die Klimaschutzziele. Politik und Wirtschaft haben sich dabei zuletzt verstärkt auf E-Mobilität als Schlüssel zur Dekarbonisierung eingeschossen. Nun zeigt sich aber, dass die Infrastruktur an vielen Stellen überhaupt nicht für das massive Hochfahren der E-Mobilität geeignet ist. Wenn Deutschland also trotz seiner Klimaziele mobil bleiben soll, braucht es Alternativen oder zumindest Ergänzungen zur E-Mobilität.

21. January 2021 – The new patent law in China

In six months, on July 1, 2021, the new regulations of the Chinese Patent Law will come into force. Here you will find an overview of the new regulations, in particular for patent infringement proceedings in China.

Erhöhte Schadensersatzansprüche: Das neue Gesetz sieht einen höheren Schadensersatz bei Patentverletzungen vor. Ist der Schaden des Patentinhabers bzw. der dem Patentverletzer entstandene Gewinn schwierig zu bestimmen, kann das chinesische Gericht einen Schadensersatz zwischen RMB 30.000 (ca. €3.800) und RMB 5.000.000 (ca. € 637.000) festlegen. Die Unter- und Obergrenze des möglichen Schadensersatzes wird verglichen mit der aktuellen Situation nunmehr auf das 3- bis 5-fache angehoben.

Geringere Beweislast für Patentinhaber: Ist es dem Patentinhaber nicht möglich, alle Beweismittel für eine Patentverletzung vorzulegen, weil sich Beweise (nur) im Besitz des vermeintlichen Verletzers befinden, sieht das neue Patentgesetz vor, dass das Gericht den Patentverletzer anweisen kann, seine Buchhaltung sowie Beweismaterial, welches sich auf die Patentverletzung bezieht, offenzulegen.

Erhöhte Strafen für Patentberühmung: Die verwaltungsrechtlichen Strafen wegen Patentberühmung (Werbung mit nicht existierenden Patentrechten) werden auf bis zu RMB 250.000 (ca. €. 32.000) deutlich erhöht.

Verlängerung der Verjährungsfristen: Für die Durchsetzung von Patentrechten wird eine längere Verjährungsfrist eingeführt. Die Frist für die Einreichung einer Klage wegen Patentverletzung oder Patentstreitigkeiten über Zahlungen von Lizenzgebühren, wird von 2 auf 3 Jahre verlängert. Die Frist beginnt zu laufen, wenn der Patentinhaber von der Patentverletzung oder Patentstreitigkeit Kenntnis hat bzw. wenn er diesen Umstand hätte wissen müssen.

Neue Patentlizenzbereitschaft: Der Patentinhaber kann (widerruflich) gegenüber dem chinesischen Patentamt (CNIPA) die Absicht erklären, jedem seine Patente mit einer festgelegten Lizenzgebühr zur Verfügung zu stellen. Im Rahmen eines schriftlichen Antrags werden die Lizenzgebühren und die Zahlungsmodalitäten festgelegt. Um die Lizenz zu erhalten, genügt eine schriftliche Mitteilung an den Patentinhaber sowie die Zahlung der im Rahmen der offenen Lizenz bekanntgegebenen Lizenzgebühr. Über die Höhe der Lizenzgebühr kann noch verhandelt werden. Zudem senkt das chinesische Patentamt für den Patentinhaber die Höhe der amtlichen Jahresgebühren soweit noch keine Lizenzen eingenommen werden.

20. January 2021 – 3D-Druck: Patent- und Designschutz sichern dauerhaft Vorreiterrolle deutscher Unternehmen

Die Coronakrise hat gezeigt, wie abhängig die Wirtschaft von globalen Lieferketten ist. Und als die Pandemie im Frühjahr ihren ersten Höhepunkt erreichte und Lieferketten unterbrochen waren, griffen viele produzierende Unternehmen auf 3D-Druckverfahren zurück. 4. December 2020 – Patentstreit zwischen Daimler und Nokia richtungsweisend für Umgang mit Standardessentiellen Patenten im Bereich IoT

Zehn Jahre nach dem „Patentkrieg“ um Smartphone-Technik sind zuletzt vor allem die Automobilhersteller zur Zielscheibe zahlreicher Patentklagen geworden. Im Patentstreit zwischen dem Netzwerkausrüster Nokia und dem Automobilhersteller Daimler vor dem Düsseldorfer Landgericht hat das Gericht nun entschieden, das Verfahren auszusetzen und dem Europäischen Gerichtshof (EuGH) vorzulegen.

12. November 2020 – Überarbeitung der EU-Rechtsvorschriften beim Schutz von Geschmacksmustern

Das bestehende europäische Designrecht bietet ein attraktives und umfassendes Schutzsystem für Designs. Für einen einheitlichen Schutz von Geschmacksmustern auf EU-Ebene ist das Amt der Europäischen Union für geistiges Eigentum (EUIPO) zuständig. Jüngst wurden die EU-Rechtsvorschriften ...

für Geschmacksmuster (Designs) von der Europäischen Kommission in Hinblick auf Effizienz, Wirksamkeit, Relevanz, Kohärenz und Mehrwerte geprüft und bewertet.

Ergebnis ist u.a., dass die Rechtsvorschriften mit Blick auf Innovationen im Bereich der Digitalisierung Anpassungsbedarf haben. Genannt werden z. B. „Unsicherheiten in Bezug auf die Möglichkeit, grafische Benutzeroberflächen oder Symbole als Geschmacksmuster zu schützen; die Möglichkeit, nicht nur statische, sondern auch dynamische Ansichten als Geschmacksmuster anzumelden; Geltungsbereich der Geschmacksmusterrechte und Umfang der Schutzschranke der privaten Nutzung im Zusammenhang mit 3D-Druck“.

Insgesamt ist beim EUIPO ein stetiger Anstieg von Geschmacksmusteranmeldungen zu verzeichnen. Dies wird auf den Erfolg des Gemeinschaftsgeschmacksmustersystems und auf die zunehmende Bedeutung, die Unternehmen dem Schutz ihrer Designs beimessen, zurückgeführt.

2. November 2020 – EU trademark law: The use of trademarks in a different form

A further step towards harmonization of trademark law in the EU:

Agreement on common decision-making practice for the use of a trademark in a form differing from its registration. (#DPMA, #EUIPN)

The trademark Offices in Europe are striving more and more to agree on a common decision-making practice in trademark law. The aim of the convergence projects is to harmonize trademark law in the EU.

Now the national Trademark Offices of the EU member states and the Office of the European Union for Intellectual Property (EUIPO) have agreed on a common decision-making practice regarding the use of a trademark in a form that differs from its registration. This came into force on 15 October 2020.

Trademarks are often developed, changed or modernized over time - and thus used in a different form. Using a trademark in a different form is associated with risks, because in principle the trademark must be used in the form in which it was registered. A right-preserving use despite deviation exists if the deviation does not change the character of the trademark (see e.g. § 26 (3) German Trademark Law).

The result of the joint decision practice now adopted corresponds to the previous decision practice of the German Patent and Trademark Office.

A detailed explanation of this convergence project can be found in the communication of the European Union Intellectual Property Network (EUIPN). This document sets out the general principles according to which it is necessary to assess when the use of a trademark in a form differing from its registration affects its distinctiveness.

9. September 2020 – Geschützte Farbmarken und deren Markenbekanntheit

Düsseldorf: Patentanwalt Matthias Rößler kommentiert im Handelsblatt die Schutzrechtsdurchsetzung einer prominenten Farbmarke.

In dem am vergangenen Freitag im Handelsblatt erschienenen Artikel "Die Telekom kämpft erbittert um ihr Magenta – Pinkbus muss umlackieren" (04.09.2020) geht es darum, wie der Telekom Konzern die Farbmarke Magenta zum wiederholten Male gegen einen ähnlichen Markenauftritt durchsetzt. Matthias Rößler kommentiert, ob ein Unternehmen eine Farbe für sich beanspruchen kann und wie weit der Schutz einer Farbmarke über das Produkt bzw. die Branche hinweg gelten kann.

5. May 2020 – Bundesgesundheitsministerium darf Patentschutz theoretisch für begrenzten Zeitraum aufheben

Die Bunderegierung hat angesichts der Coronavirus-Krise jüngst das Infektionsschutzgesetz angepasst und erweitert, insbesondere um die Möglichkeit bundesweiter Anordnungen in bestimmten Bereichen. Das könnte auch das Patentrecht betreffen.

Denkbar wäre eine Anordnung zur Nutzung erteilter Patente durch Dritte, um sicherstellen zu können, dass Medikamente und Impfstoffe gegen das Coronavirus in Deutschland allgemein zugänglich sind.

In §13 des deutschen Patentgesetzes ist diese Möglichkeit bereits vorgesehen: „Die Wirkung des Patents tritt insoweit nicht ein, als die Bundesregierung anordnet, dass die Erfindung im Interesse der öffentlichen Wohlfahrt benutzt werden soll. Sie erstreckt sich ferner nicht auf eine Benutzung der Erfindung, die im Interesse der Sicherheit des Bundes von der zuständigen obersten Bundesbehörde oder in deren Auftrag von einer nachgeordneten Stelle angeordnet wird.“ Das Patentgesetz sieht für diesen Fall auch eine „angemessene Vergütung“ vor. Diese Regelung wurde bisher noch nie in Anspruch genommen, jedoch wäre ihre Anwendung vor dem Hintergrund der Corona-Pandemie zumindest vorstellbar.

Das Bundesgesundheitsministerium oder eine nachgeordnete Behörde könnte anordnen, dass (bereits erteilte) Patente von Pharmaunternehmen und Forschungsinstitutionen durch Dritte benutzt werden können, um Maßnahmen zur Sicherstellung der Versorgung mit Arznei- und Heilmitteln ergreifen zu können. Dabei könnte es um bereits bekannte, patentierte Wirkstoffe gehen, die in Betracht gezogen werden, gegen Corona-Viren helfen zu können.

Eine derartige Anordnung wäre gegebenenfalls auch denkbar, um eine flächendeckende Versorgung mit Medizinprodukten, Produkten zur Desinfektion und im Bereich der Labordiagnostik sicherzustellen.

4. May 2020 – Policies taken by the Offices in relation to the corona virus (COVID-19) - This note will be updated regularly.

The current situation with regard to the corona virus has the following consequences at the German Patent and Trademark Office (GPTO), the European Patent Office (EPO) and the European Union Intellectual Property Office (EUIPO).

GPTO: All hearings and oral proceedings are cancelled until 6 June 2020. Regarding current prosecution proceedings all time limits set by the GPTO are extended until 4 May 2020; this does not apply to deadlines defined by law (e.g. opposition periods, renewal deadlines, ….). The office announced that deadlines set by the GPTO will be extended appropriately upon request. However, GPTO also explained that deadlines given by Law cannot be extended but if someone would fail to meet such deadlines without one's fault, GPTO may, upon request, grant a re-establishment of rights. GPTO's Arbitration Board for Employees' Inventions extended ex officio all open pleading deadlines until 15 May 2020. Public events scheduled for March 2020 are cancelled. Information offices and research rooms are closed. There will be significant delays in processing.

EPA: Proceedings before examining and opposition divisions will be held by videoconferences as long as an approval for that has been granted. All other oral proceedings scheduled until 15 May 2020 will be postponed. The EPO announced to extend time limits (expiring on or after the date of 15 March 2020) until 2 June 2020. According to article 150(2) EPC, this also applies to international applications under the PCT. Oral proceedings in the premises of the Boards of Appeal from 16 March 2020 until 27 March 2020 are postponed. Since business trips between the EPO sites scheduled for the next 2 months are cancelled, this may cause effects to oral proceedings.

EUIPO continues all its services electronically. All time limits in proceedings before the Offices expiring between 9 March 2020 and 17 May 2020 are extended until 18 May 2020. This does not apply to deadlines that cannot be extended by Law, e.g. the opposition period. For detailed information, please visit the EUIPO website. EUIPO's headquarters are closed because of the 'state of alarm' in Spain. All official events are cancelled.

23. March 2020 – German Constitutional Court holds UPC-implementation unconstitutional

On March 20, the German Constitutional Court (Bundesverfassungsgericht, BVerfG) announced its decision on the constitutional complaint against the implementation of the Unitary Patent Court (UPC).

The Act of Approval to be deemed as void. It amends the Constitution in substantive terms, but the two-thirds majority, that would have been required, was not approved by the German Bundestag. The Court stated that "in order to secure their right to influence the process of European integration by democratic means, this, in principle, also entails the right of citizens that sovereign powers be conferred only in the ways provided for by the federal conctitution". The judges declared: “An Act of Approval to an international treaty that has been adopted in violation thereof cannot provide democratic legitimation for the exercise of public authority by the EU or any other international institution supplementary to or otherwise closely tied to the EU.”

The UPC agreement is an integral part of the project started in 2013 to create a Unitary Patent covering almost all EU member states. The Unitary Patent can only come into existence when a Unitary Patent Court exists. Whether the issues concerning the plans for a Unitary Patent will be renegotiated in the near future seems doubtful - not least because of the current Corona pandemic and Brexit. For the time being, the more pressing political and legislative matters will have to deal with COVID-19.

18. December 2019 – Patent examination in China: Adaptation of CNIPA guidelines

By November 1, 2019, some changes to the guidelines for patent examination in China by the CNIPA (China National Intellectual Property Administration) came into force.

One of the adaptations is the possibility for applicants to request a delayed examination of patentability. This rule applies to patents and designs, but not to utility model applications.

In the case of a patent application, the request for delayed examination shall be made at the time of the request for substantive examination. In the case of a design application, the request must be filed at the time of filing the design application. The examination may be delayed by 1, 2 or 3 years from the date on which the application takes effect.

For the patent application, this procedure can have the advantage that the applicant can adapt the scope of protection for a longer period of time or, for example, file a divisional application.

For a design application, the advantage of the request for a delayed examination is that the publication of the design, which is i.a. linked to the payment of the registration fee, can be postponed for a longer period.

CNIPA was established in August 2018; from the former Chinese Patent and Trademark Office (SIPO - Intellectual Property Office of China). Since then, CNIPA has been supervised by the newly established State Administration for market surveillance and market administration. Besides patents, utility models and designs, CNIPA now also deals with trademarks and geographical indications.

11. December 2019 – The Unitary Patent Court: The German decision is expected at the beginning of 2020

For some years now, the establishment of a European Unitary Patent and a Unitary Patent Court within the EU member states has been discussed. In order for it to come into effect, the agreement must be ratified by all EU member states.

According to professional sources, the Federal Constitutional Court is seeking to reach a decision at the beginning of 2020 on the constitutional complaint that has been pending since 2017 against the ratification of the Convention for an Unitary European Patent Court in Germany.

However, a decision by the Federal Constitutional Court may be delayed as the ministry of justice announced this summer that the government will not ratify the agreement until the impact and consequences of the upcoming Brexit are clear.

The UK's date of withdrawal from the European Union has been postponed several times since the EU referendum in 2016; most recently to January, 31st 2020.

It is still uncertain whether the court will decide in time for the United Kingdom to participate in the new patent court. Only those EU member states can be part of the Unitary Patent Court (UPC) which have ratified the agreement when the UPC enters into force.

30. August 2019 – News UPC Germany: No ratification of UPCA as long as consequences Brexit are not known

The German Federal government will not proceed with ratification of the UPCA until the consequences of the Brexit are confirmed. In a letter this August the German Justice Ministry stated:

“The issue of the withdrawal of the United Kingdom from the European Union (so-called Brexit) and its implications for European patent reform play an important role in the further implementation process of the Unified Patent Court Agreement. The real and legal implications of withdrawing must be examined with regard to the Agreement and agreed at European level. This opinion forming is currently not finalized, not least because significant factors of the expected exit are not yet known.”

The letter from the German Justice Ministry comes as a constitutional complaint against the UPCA and is expected to be heard before the German Federal Constitutional Court later this year or at the beginning of 2020.

The Unitary Patent system has already suffered delays due to the constitutional complaint. It remains to be seen how the letter from the Justice Ministry will affect the ratification process and the outcome of the constitutional complaint.

5. April 2019 – BREXIT and the consequences for owners of patents, trademarks and designs

The UK's withdrawal from the European Union without contractual arrangements on 12 April 2019 (or later), the so-called hard BREXIT, will have serious consequences for owners of Intellectual Property rights. The same applies to a regulated BREXIT which would become effective on 31 December 2020 (or any other date to be agreed). We recommend to all owners of patents, trademarks and designs who are dependent on maintaining their rights in the UK:

In summary, one can say that owners and licensees of patents - to the present state of knowledge - can rely on the continued validity of existing legal regulations.

Owners of trademarks and designs, who need an extensive protection in the UK, should now act and verify a preventive national application in the UK.
