13. February 2020 – Change of our law firm name
We would like to inform you that our law firm is as of now changing its legal name to

We are delighted that "karo IP" has become an official part of our legal name in the German Partnership Register effective as of January 13, 2020.

18. December 2019 – Patent examination in China: Adaptation of CNIPA guidelines
By November 1, 2019, some changes to the guidelines for patent examination in China by the CNIPA (China National Intellectual Property Administration) came into force.
One of the adaptations is the possibility for applicants to request a delayed examination of patentability. This rule applies to patents and designs, but not to utility model applications.
In the case of a patent application, the request for delayed examination shall be made at the time of the request for substantive examination. In the case of a design application, the request must be filed at the time of filing the design application. The examination may be delayed by 1, 2 or 3 years from the date on which the application takes effect.
For the patent application, this procedure can have the advantage that the applicant can adapt the scope of protection for a longer period of time or, for example, file a divisional application.
For a design application, the advantage of the request for a delayed examination is that the publication of the design, which is i.a. linked to the payment of the registration fee, can be postponed for a longer period.
We are happy to advise and support you concerning the examination of the facts and the possibilities of implementation with regard to your IP rights in China.
CNIPA was established in August 2018; from the former Chinese Patent and Trademark Office (SIPO - Intellectual Property Office of China). Since then, CNIPA has been supervised by the newly established State Administration for market surveillance and market administration. Besides patents, utility models and designs, CNIPA now also deals with trademarks and geographical indications.
11. December 2019 – The Unitary Patent Court: The German decision is expected at the beginning of 2020
For some years now, the establishment of a European Unitary Patent and a Unitary Patent Court within the EU member states has been discussed. In order for it to come into effect, the agreement must be ratified by all EU member states.
According to professional sources, the Federal Constitutional Court is seeking to reach a decision at the beginning of 2020 on the constitutional complaint that has been pending since 2017 against the ratification of the Convention for an Unitary European Patent Court in Germany.
However, a decision by the Federal Constitutional Court may be delayed as the ministry of justice announced this summer that the government will not ratify the agreement until the impact and consequences of the upcoming Brexit are clear.
The UK's date of withdrawal from the European Union has been postponed several times since the EU referendum in 2016; most recently to January, 31st 2020.
It is still uncertain whether the court will decide in time for the United Kingdom to participate in the new patent court. Only those EU member states can be part of the Unitary Patent Court (UPC) which have ratified the agreement when the UPC enters into force.

23. September 2019 – AIPPI Annual Meeting – reconnecting with clients, colleagues and friends. Thank you, London!
Our partner Matthias Rößler attended the AIPPI – International Association for the Protection of Intellectual Property World Congress 2019, which took place in London last week.
It has been four days of inspiring debates, interesting educational opportunities, intensive networking and great discussions with clients and colleagues all over the world. Many thanks to the UK Group of AIPPI for organizing this interesting congress.

30. August 2019 – News UPC Germany: No ratification of UPCA as long as consequences Brexit are not known
The German Federal government will not proceed with ratification of the UPCA until the consequences of the Brexit are confirmed. In a letter this August the German Justice Ministry stated:
“The issue of the withdrawal of the United Kingdom from the European Union (so-called Brexit) and its implications for European patent reform play an important role in the further implementation process of the Unified Patent Court Agreement. The real and legal implications of withdrawing must be examined with regard to the Agreement and agreed at European level. This opinion forming is currently not finalized, not least because significant factors of the expected exit are not yet known.”
The letter from the German Justice Ministry comes as a constitutional complaint against the UPCA and is expected to be heard before the German Federal Constitutional Court later this year or at the beginning of 2020.
The Unitary Patent system has already suffered delays due to the constitutional complaint. It remains to be seen how the letter from the Justice Ministry will affect the ratification process and the outcome of the constitutional complaint.
15. July 2019 – Chinese IP Workshop in Munich
On June 24, 2019, KARO IP attended the 2nd Chinese IP Workshop taking place at the European Patent Office in Munich.
The workshop was hosted by the Principal Director of User Services and Quality Management Mr. Niclas Morey and Mr. Jeremy Scott as sponsor of the Asian Patent Expert Group (APEG). The event´s topics surrounded new development of the EPO as well as CII (computer implemented invention).
APEG, the Asian Patent Expert Group, focuses on the development of patent law and practice in Asian, especially in China.
The successful seminar attracted about 40 people; among them corporate IP legal professionals, head of corporate technologies and patent attorneys.

25. June 2019 – Congratulations to our new European Patent Attorney
Some more good news from KARO IP! We are glad to announce the outcome of this year’s European Qualifying Exam. Our colleague Leonard Lotz passed the exams and is now authorised European Patent Attorney.
With this authorisation, he may represent KARO IP´s clients before the European Patent Office (EPO). Congratulations on this great achievement, well done!

3. June 2019 – Lecture at the European Patent Office
Dr. Yingkun Brunner was invited by the European Patent Office (EPO) to give a lecture for their examiners on June 3, 2019.

27. May 2019 – INTA Annual Meeting – reconnecting with clients, colleagues and friends. Thank you Boston!
KARO IP, participating this year’s INTA in Boston, Massachusetts, appreciated the five days of interesting educational opportunities, intensive networking and great discussions with clients and colleagues all over the world.
We hosted the meetings at several places around the convention center and had very inspiring debates. Sincere thanks are given to them all.

Since May 2019 Matthias Rößler is a member of the LES Deutsche Landesgruppe e.V.
The Licensing Executives Society (LES) is an international association of experts in the field of licensing and technology transfer.
In the future, Mr. Rößler plans to actively participate in the LES Working Group “Vehicles”, which, in addition to the topics of licensing and technology transfer, deals with sectoral IP topics. As part of regular workshops and events, a hands-on exchange of experience between experts takes place.

The German national group based in Nottuln, NRW is - after USA/Canada - the second largest LES country group. Worldwide, the association is represented with more than 10,000 members in almost 100 countries.
5. April 2019 – BREXIT and the consequences for owners of patents, trademarks and designs
The UK's withdrawal from the European Union without contractual arrangements on 12 April 2019 (or later), the so-called hard BREXIT, will have serious consequences for owners of Intellectual Property rights. The same applies to a regulated BREXIT which would become effective on 31 December 2020 (or any other date to be agreed). We recommend to all owners of patents, trademarks and designs who are dependent on maintaining their rights in the UK:
Check your portfolio now and make appropriate provisions.
Monitor the further developments frequently. We are happy to assist you!
In summary, one can say that owners and licensees of patents - to the present state of knowledge - can rely on the continued validity of existing legal regulations.
Owners of trademarks and designs, who need an extensive protection in the UK, should now act and verify a preventive national application in the UK.

20. December 2018 – Extended Strategic Cooperation of Law Firms
The cooperation of the patent law firm Kahlhöfer Rößler Kreuels Patentanwälte PartG mbB with Braun-Dullaeus Pannen Patent- und Rechtsanwälte at the “Platz der Ideen” in Duesseldorf will be expanded.
As announced on December 19, Braun-Dullaeus Pannen will merge with a team of Dr. Emmerling (Munich) at January 1, 2019. We truly value the the association called Braun-Dullaeus Pannen Emmerling and we welcome our new colleagues Dr. Friedrich Emmerling, Dr. Ju Min Kim, Franck Klein, Jürgen Pierau and Jörg Kohlschmidt in our organization.
Kahlhöfer Rößler Kreuels PartG mbB cooperates with Braun-Dullaeus Pannen since January 2018. With this successful collaboration the team of patent attorneys has been able to greatly expand and bundle the technical and scientific know-how as well as the national and international firms’ network.

On July 13, 2018, KARO IP and Yantai Intellectual Property Association hosted the seminar “IP in Europe” in Yantai, Shandong Province.
Mr. Athanassios-Andreas Stamatopoulos, former principal director at the European Patent Office (EPO), Mr. Matthias Rößler, LL.M., Partner of KARO IP, and Dr. Yingkun Brunner, China Desk/KARO IP, presented different topics about Intellectual Property in Europe. The event´s topics surrounded recent development at the European Patent Office (EPO), Faster Processing at the EPO, EU Trademark, Unitary Patent and Unified Patent Court, German Utility Model, CII Patenting before the EPO, EU Design Patent, etc. The successful seminar attracted more than 40 people; corporate IP legal professionals, head of corporate technologies and attorneys.
29. May 2018 – Location expansion: KARO IP in Munich
From 1 June 2018, KARO IP will be present with an office in the heart of Munich. "In particular our Asian clients appreciate our location at the Sckellstr. 6 at the Maximilaneum, which stands out for its historic Munich ambience," founding partner Kreuels comments this step.

Even in the days of KNH Patentanwälte (until December 2017), the patent attorneys regularly worked in the former KNH office in Munich.
1. May 2018 – Office expansion at the Platz der Ideen 2 in Duesseldorf
On May 1, 2018, KARO IP will expand its office space at the Platz der Ideen 2. The founding partners Rößler and Kreuels decided to take this step a few months after the successful foundation of the law firm KARO IP at the Platz der Ideen. Among other things, new offices will be created for the growing team around the former partners of KNH Patentanwälte.
1. February 2018 – Admission of patent attorney Leonard Lotz
We look forward to having our experienced associate and patent attorney candidate Leonard Lotz now in our team of patent attorneys directly after his admission to the patent attorney.
Leonard Lotz began his training at KNH Patentanwälte and has been supporting the patent attorneys Rößler, Kreuels and Kahlhöfer since 2014.

15. January 2018 – karo IP - Foundation January 2018
After several years of joint activity at KNH Patentanwälte in Duesseldorf, Hermann Kahlhöfer, Matthias Rößler and Justus Kreuels took the initiative to found the law firm karo IP - Kahlhöfer Rößler Kreuels Patentanwälte PartG mbB at the beginning of 2018.
In this law firm pioneering new concepts for an efficient, comprehensive and forward-looking consultation should be realized. The bundled experience, the extensive expertise and the commitment of the patent attorneys serve the well-being of many national and international clients.
We are pleased about the large number of loyal clients who continue to work with us immediately after the foundation of KARÒ IP.
We were able to realize our goal of comprehensive consulting in all areas of technology and intellectual property with sufficient capacity and experience with other patent attorneys and lawyers. With the established patent and law firm Braun-Dullaeus Pannen, we have a partner who has relevant experience in the enforcement of property rights in Germany and in trademark law. With our office community, a constructive and efficient exchange is now possible.
